REGULATION for PACKAGING WASTE MANAGEMENT
PART ONE
Objective ,Scope,Resource and Definition
ARTICLE 1 – (1) Objective of this regulation;Determination of principles,politics and programs plus legal,managerial and technical points regarding
a) The production of packagings having definite criterion,essential condition and properties,
b) Prevention of packaging wastes;reduction of the disposable quantity of the inevitable packaging wastes by means of using reuse,recycling and reclamation methods,
c) Prevention of the presentation of the packaging wastes (causing an environmental damage) directly or indirectly to the receiving ecosystem
d) The establishment of the technical and managerial standards concerning the seperate accumulation at source ,collection,transportation,seperation and recycling of the packaging wastes as part of a particular managerial system.
PART TWO
Main Principles , Tasks, Competence and Liabilities
ARTICLE 5 – (1) The principles regarding the management of the packaging wastes are mentioned as follows :
a) It is essential that the prevention of the creation of the packaging wastes aiming to preserve the natural resources ,carry on the production in accordance with the sustainable environment and development principles and decrease the quantity of waste and in case of the production is inevitable then the priority would be given to reuse,recycling,reclamation and to use as an energy source.
b) Aiming to take under control the consumption of disposable packaging and waste of these materials,it is essential to prefer the reusable packagings.
c) The delivery of the packaging wastes directly or indirectly to the receiving ecosystem and the abatement by means of storing at regular storage areas is prohibited.
ç) The responsible people and corporations in charge of management of packaging and packaging wastes are liable for taking the necessary measures to decrease the harmful effects of these packaging and packaging wastes over human and environmental health .
d) In the event that the Ministry would consider it necessary ,concerned parties would be liable to present the audit reports to the Ministry having audited the declarations as part of this regulation and the related documents by independent audit companies .
e) Aiming to decrease environmental pollution ,to utilize the regular storage facilities efficiently and to support the economy , the packaging wastes should be stored seperately than the other wastes regardless of the initial composition structure and the sourcing .
f) It is essential to accumulate and collect the packaging wastes seperately at source to establish a healthy recycling and reclamation system.But the wastes having Ministry approval for being collected and kept inside the common accumulation equipments together with the packaging wastes are allowed to be accumulated and collected together with packaging wastes.
g) It is essential that the expenses related with the compensation of all types of environmental damages resulting from management of packaging wastes to be covered by individuals and / or legal entities within the framework of severally responsibility principle.
ğ) Packaging waste process plants having ongoing operations or planning to start activity in the fields of packaging waste collection, segregation,recycling and reclamation are obliged to take license of environment.
h) Recycling activity of the packaging wastes consisting process details of cleaning ,rehabilitation or control treatments would abide by the provisions mentioned by Waste Management Regulation.
ı) Packaging waste that is not economically recyclable or not possible to recycle is processed for energy recovery purposes.
i) It is essential that disposable packaging be included in the recycling / recovery process after consumption
j) It is essential to carry out preventive activities to reduce and improve the amount of materials and contents of the contents of packaging and packaging waste by developing clean products and technologies, starting from the design of the packaging, to production, marketing, distribution, use, waste and disposal. For this purpose, it is essential that the heavy metal contents of the packages to be produced are minimized in such a way that the unit weight of the package does not deteriorate the function of the packaging and adversely affect the required level of health, cleanliness and security.
k) Packaging waste collected in line with the system defined in this Regulation must be supplied to environmentally licensed packaging waste processing plants.m)It is essential that the use of plastic bags throughout the country be reduced to not exceed 40 pcs per person per person per year, up to 90 pcs per person up to 31/12/2019, and up to 40 pcs per person up to 31/12/2025. Very light plastic bags are outside these goals.
n) Plastic bags, including sales made with distance contracts starting on 1/1/2019, can not be provided free of charge to the user or consumer at points of sale, and can not be included in any promotions or campaigns that would allow free supply. Very light plastic bags are exempt from this practice.
o) The base fee to be applied to the plastic bags shall be determined by the Ministry considering the market conditions and the proposal of the Packaging Commission consisting of the representatives of the relevant sector every year and shall remain valid for the following year.
